Elabora un
protocolo en el que se regula el nuevo escenario tras la pandemia sobre los
mercados de contratación y sus plazos, la prórroga de los contratos y las
obligaciones de los intermediarios.
La Federación
Española de Fútbol (RFEF), y cada una de las otras 210 federaciones nacionales
de la FIFA, tendrán la potestad de fijar su propia ventana de fichajes
adaptándola al final de sus respectivos campeonatos, según la orden que ha
trasmitido la organización. Esto supone que el próximo período de
contrataciones no se iniciará necesariamente el 1 de julio, como era norma, si
no que lo hará cuando lo estipule la RFEF, avalada por la FIFA. Así lo confirmó
a este periódico Emilio García-Silvero, el gallego que está al frente del
departamento jurídico de la Federación Internacional, que además ha sido el
impulsor del protocolo a seguir en todos los clubes y ligas del mundo tras el
impacto del COVID-19.
Este periódico ha
tenido acceso al documento liderado por García-Silvero y elaborado por el Grupo
de Trabajo formado por la FIFA, sus seis confederaciones, las 211 Federaciones
nacionales, la Asociación de Clubes Europeos (ECA), la FIFPRO y el World
Leagues Forum. En la guía se establecen una serie de pautas a seguir. En lo
referente a las ventanas de fichajes se establece la autonomía de cada país
para fijar la suya propia según la finalización de sus repectivos campeonatos:
"El primer periodo de inscripción comenzará tras la finalización de la temporada y
terminará, por regla general, antes del inicio de la nueva temporada. Este
periodo no deberá durar más de doce semanas. El segundo periodo de inscripción
comenzara a mediados de temporada y no deberá durar mas de cuatro semanas. Los
dos periodos de inscripción de temporada deberán introducirse en el TMS, al
menos con 12 meses de antelación antes de que entren en vigor. La FIFA fijará
las fechas de ls periodos de cualquier federación que no los comunique".
Las instrucciones
a seguir sobre la finalización de los contratos, también están recogidas en el
documento, donde se dice textualmente que:
* Si un contrato
vence en la fecha de finalización original de la temporada, dicho vencimiento
deberá prolongarse hasta la nueva fecha de finalización de la temporada.
* Si un contrato
comienza en la fecha de inicio original de la próxima temporada, dicho comienzo
deberá posponerse hasta la nueva fecha de inicio de la próxima temporada.
* En caso de que
se produzca un solapamiento de temporadas o períodos de inscripción, y a menos
que todas las partes acuerden otra cosa, se dará prioridad al club anterior
para completar la temporada con su equipo original, a fin de salvaguardar la
integridad de las ligas nacionales, las competiciones de las FM y las
competiciones continentales.
* Sin perjuicio
de las enmiendas recomendadas a las fechas de los contratos, toda remuneración
pagadera por contrato antes de la fecha de inicio de un contrato deberá
aplazarse hasta la nueva fecha de inicio de la próxima temporada o el primer
período de inscripción. Los principios rectores a seguir sobre la finalización
de los contratos serán los siguientes:
* Se aprobarán
todas las solicitudes de ampliación de la fecha de finalización de la temporada
actual; se aprobarán todas las solicitudes de ampliación o enmienda de los
periodos de inscripción que ya hayan comenzado, siempre y cuando su duración no
supere el límite máximo (es decir, 16 semanas).
* Se permitirá a
las federeaciones modificar las fechas de la temporada y/o los periodos de
inscripción, tanto a través del TMS como mediante notificación a la FIFA fuera
de este sistema.
* Como excepción
al art. 6, apdo. 1 del RETJ, un profesional cuyo contratoaya vencido o se haya
rescindido a consecuencia de la COVID-19 tendrá derecho a ser inscrito por una
federación fuera del periodo de inscripción, con independencia de la fecha de
vencimiento o rescisión.
