El contrato existente entre el jugador y el club parisino garantiza su continuidad, incluso en caso de lesión

El Paris Saint Germain no se plantea rescindir el contrato de Sergio Ramos. Pese a las informaciones aparecidas en las últimas horas, fuentes próximas al jugador han confirmado al Mundo Deportivo que ahora mismo no están en ningún momento en este escenario.
Varios son los argumentos. Empezando por el propio contrato que el futbolista tiene firmado para las dos próximas temporadas a razón de 10 millones netos por temporada. El contrato y la normativa francesa impide ahora mismo este escenario.
La normativa FIFA es clara
La normativa FIFA permite proteger a Sergio Ramos al encontrarse en el llamado período protegido. Así lo recoge el artículo 17 de Reglamento sobre el Estatuto y Transferencia de Jugadores. Dicho artículo deja claro primero que el PSG debería pagar una indemnización si rescindiera el contrato: “En todos los casos, la parte que rescinde el contrato se obliga a pagar una indemnización. Bajo reserva de las disposiciones sobre la indemnización por formación del art. 20 y el anexo 4, y salvo que no se estipule lo contrario en el contrato, la indemnización por incumplimiento se calculará considerando la legislación nacional, las características del deporte y otros criterios objetivos.
La indemnización se fija conforme se fija en función de “la remuneración y otros beneficios que se adeuden al jugador conforme al contrato vigente o al nuevo contrato, el tiempo contractual restante, hasta un máximo de cinco años, las cuotas y los gastos desembolsados por el club anterior (amortizados a lo largo del periodo de vigencia del contrato), así como la cuestión de si la rescisión del contrato se produce en un periodo protegido”.
Y es precisamente este periodo protegido otro elemento a tener en cuenta. Este derecho protege a los clubes y también a jugadores en los primeros tres años de vinculación del jugador con el club.
En este caso, al ser el club quien lo rompería, se expondría el PSG a una sanción además de la indemnización: “Además de la obligación de pago de una indemnización, deberán imponerse sanciones deportivas al club que rescinda un contrato durante el periodo protegido, o que haya inducido a la rescisión de un contrato”.
Dos periodos sin inscribir jugadores en España y Europa
La sanción es muy dura y supondría la prohibición para la “inscripción de nuevos jugadores, tanto en el ámbito nacional como en el internacional, durante dos periodos de inscripción completos y consecutivos. El club podrá inscribir nuevos jugadores, tanto en el ámbito nacional como en el internacional, solo a partir del próximo periodo de inscripción posterior al cumplimiento íntegro de la sanción deportiva respectiva”.
