La Liga Santander Todavía falta escuchar a la RFEF.
El titular del Juzgado número 2 de lo Mercantil de Madrid ha negado a LaLiga las medidas cautelares "in audita parte", sin escuchar a la RFEF, en el conflicto por los partidos de los lunes y los viernes.
El auto, que ha sido notificado este jueves, rechaza mantener las medidas cautelares sin escuchar a la Federación "al no aparecer justificadas las razones de urgencia exigidas al respecto efecto" en la Ley de Enjuiciamiento Civil. En los próximos días, cuando también se conozca la otra versión además de la de LaLiga, decidirá.
El juez reconoce a la RFEF el derecho a dar su opinión al respecto y cita a ambas partes a una vista ante el tribunal el próximo 6 de octubre. Así y de momento, el nuevo campeonato liguero arrancará sin partido los lunes y los viernes hasta que se vuelvan a reunir LaLiga y la Federación para llegar a un acuerdo. La RFEF ya lo aceptó el curso pasado.
Como explica el auto, LaLiga invocó para conseguir su pretensión "una urgencia especial que en modo alguno puede considerarse obvia" y además se abstuvo, "no ya de acreditar, sino incluso de proporcionar en el plano meramente alegatorio aquellas razones por las que, en su sentir, la audiencia de la parte demandada con carácter previo a la adopción de una decisión al respecto pueda llegar a privar de eficacia o a hacer ilusoria la resolución correspondiente".
